I agree 100% but to me, no one is a psychic therefore if it came down to needing to defend yourself the threat exists until the aggressor is either restrained or incapacitated. Restraint being rather difficult without people to help out, most should end in incapacitated in some form or another. But I bet more often than not that would not work in a court room.

My arguement (which gets many disagreements) is that not getting in a fight is better than winning a fight. Don't be somewhere you don't belong, don't make yourself a target, and you won't have to worry about defending yourself.

I bet you'd love it. I served on three, can't wait for another.

One tip: when yer selected, then chosen, hear the case and are on the way to the jury room, try to get kind middle in the line (walkin down the hall). There'll be one or two who always Must be first. But if there is another one (or more) that also seems to be especially antsy to get into the room, be behind that one. Then, when you enter the jury room, if the chair at the head of the table (closest) is open, take it, but take it calmly and confidently as if it has your name on it.

One of the first things after the bailiff's "Welcome" is choosing a Foreman. Odds are if the person in that head chair is a decent sort- the rest have gotten a chance during the trial to sense that- he will be the first candidate.
Accept.

This is very generalized, of course, and is somewhat more complicated in theory, but taking that spot does many good things for you and the jury and the case, and the extra work and responsibility is a small inconvenience.

I took that chair on my first trip solely by accident. I like to sit at or near the end so I can see and esp. hear everyone equally well. And right off the bat I was made Foreman.
My next two trips I did as I stated above, again, instant Foreman.
*** OOPS! Just remembered, second case, yes, I was nominated right away, but so was another person whom I had decided earned my respect. I then declined. Worked out well.

Now things in a jury deliberation can get pretty chaotic (3 of 3) so you will be quickly asking yourself who you most trust as Foreman. The answer will probably be You.

[What about the others antsy going in? Well if one grabbed that chair the chance is excellent he wants the Foreman spot. And his idea of fair selection is more "First Come First Served" than consensus. This person may be dangerous. A tyrant Foreman can make a jury room he11.

Exactamundo! Avoid the situation if possible. And instead of standing your ground when a mugging seems imminent, remember that "Pride goeth before a Maul".
Get outta there before ya get hit.

But then there's the 'datdidit' hormone that floods in when your nose is broken, and the onliest thing to do is turn the attacker into gutter ooze. Of course that could lead to a lawsuit, since anyone stoopid enough to attack you is no doubt a flaming Liberal to begin with, and that particular religion subscribes to the belief that the attacker is innocent because he had an unhappy childhood and any response- even to save your own life- by you makes you a criminally liable racist bigot right-wing whack job, and it's Bush's fault.

So be careful out there.

Imho, the best one can do, generally speaking, is what you say, try to hear both sides. Sometimes it aint easy, but if you can do it you are the kind of juror I want if ever I'm there.

Is there anything worse, in this genre, than a scumbaggie who gets off free because his shyster lawyers (yeah, redundant I know) prepped him for court with a shower, haircut and a new suit, and half of the jurors were there only because they got a paid day off from work?

$10 + $13 travel is a 'paid' day?:D

First our legal system is not just. It is designed to prevent anyone from railroaded if everyone tells the truth. If someone lies then all bets are off.

Evidence that can prove a persons guilt can be withheld if it wasn't obtained according to guidelines defined in the law. So in fact a known guilty person can and often do walk free because evidence was deemed to have been obtained in an unlawful manner.

Second we are all humans and we allow our emotions to influence us. Lawyers are trained to manipulate our emotions in an effort to get the result they are looking for. A defense lawyer is not looking of justice he is looking to get his client off. So he will utilize any method to accomplish that.

Today I believe there is a high number of innocent people sitting in jail and a high number of guilty people running free in the streets.

It is my prayer that I never find myself being judged by our legal system.

Have ya ever seen some of the people sitting in a jury selection area?
